FSSAI stands for Food Safety and Standards Authority of India, an organization that monitors and governs the business of food in India. It checks the quality and standard of any food item produced before it is rolled out in the market. It ensures that the food item is completely safe for people. FSSAI is an autonomous body that is established under the Ministry of Health and Family Welfare.
Food Business Operators in India are required to register themselves under this law. Every business operating in the food industry in India is required to get FSSAI registration, which includes the manufacturers, suppliers, distributor or any other kind involved in the food business. There are three major types of food license and registration including the basic registration, state-level license and the central level license.
FSSAI registration is beneficial to the food business in several ways.
The information required to get FSSAI registration are as follows-
- Certificate of incorporation of the company, the MOA, AOA and the PAN Card of the company.
- Self Attested copy of PAN Card and Address proof of the director, partner or the proprietor. The address proof may include Aadhar Card, Passport of the Voter ID of the concerned person.
- 2 photographs each of the director, partner of the proprietor.
- A cancelled cheque crossed and signed by the authorised signatory.
- NOC from the owner of the property on stamp paper of Rs.10 and notarized as well.
- Rent Agreement.
- Water or Electricity bill that is not more than 2 months old.
A login is to be created at first in the food license website and start filling in Form-A.
Fill in the required details about your company and select the food category.
Fill in the KYC details of the director.
After filling in the form, select your bank details and make the necessary payment of registration fees.
Submit the duly filled form to the portal.
After scrutinizing the details and documents uploaded, your application for FSSAI registration will get approved by the department. FSSAI code is issued along with the certificate for your business.
There are three categories of return filing for an FSSAI merchant.
The following entities are exempted from filing of annual returns.
If any company has missed filing the return within the given stipulated time period, then it is required to pay a penalty of Rs. 100 per day until it files the return.
Food quality not compliance with the Act - 2 Lakhs
Sub Standard Food - 5 Lakhs
Misbranded Food - 3 Lakhs
Misleading Advertisement - 10 Lakhs
Extraneous Matter in food - 1 Lakh rupees
Failure to comply with food safety - 2 Lakh rupees
Unhygienic Food Manufacturing - 1 Lakh rupees
A company dealing with any food-related item is required to obtain an FSSAI license.
