Subsequently, a decision is made to either grant the PSARA Licence in\u00a0<strong>Form-IV<\/strong>\u00a0or reject the application based on compliance and other factors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Punishment Under PSARA Act for Private Security Agencies for Contravention of Provisions<\/h2>\n\n\n\n<p>The punishment under PSARA Act for private security agencies for the contravention of provisions under PSARA are given below:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Contravention of Section 4:<\/h3>\n\n\n\n<p>The punishment for violation of section 4 of the Act is as following:<\/p>\n\n\n\n<ul>\n<li>Imprisonment for a term that may extend up to&nbsp;<strong>one year<\/strong>, or<\/li>\n\n\n\n<li>A fine ranging from a minimum of ten thousand rupees to a maximum of&nbsp;<strong>twenty-five thousand rupees<\/strong>, or<\/li>\n\n\n\n<li>Both imprisonment and fine, as deemed appropriate.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Contravention of Sections 8, 9, or 11:<\/h3>\n\n\n\n<p>The punishment under PSARA Act for contravention of these sections of the Act are:<\/p>\n\n\n\n<ul>\n<li>A fine of not less than&nbsp;<strong>five thousand rupees<\/strong>&nbsp;but not exceeding&nbsp;<strong>twenty-five thousand<\/strong>&nbsp;rupees.<\/li>\n\n\n\n<li>Additionally, as a punishment under PSARA Act the PSARA licence held by the private security agency may be suspended or cancelled.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Offences by Companies under PSARA Act<\/h2>\n\n\n\n<p>When a company is penalised under the PSARA Act, individuals in authoritative roles within the company during the time of the violation or those responsible for overseeing and answerable for the company&#8217;s business conduct alongside the company itself, are regarded as responsible for the transgression. Consequently, they can face legal actions and punishment under PSARA Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Offences Punishable by Trial<\/h2>\n\n\n\n<p>Offences that entail penalties under the PSARA Act must be addressed by a Judicial Magistrate of the First Class possessing authority in the area where the offence occurred.
